TERMS AND CONDITIONS OF HOTEL KASZTELAN***

§1 Subject of the Terms and Conditions
- These Terms and Conditions (hereinafter referred to as the "Terms") define the rules for the provision of services, liability, and stay on the premises of the hotel property "Hotel Kasztelan***" in Dobczyce, ul. Przedbronie 3, 32-410 Dobczyce.
- The Terms also define the rules for the provision of services by electronic means, making online bookings, remote check-in procedures, and electronic payment processing via the website www.hotelkasztelan.pl.
- These Terms constitute an integral part of the contract, which is concluded by making an online booking and paying for the stay, completing an online or on-site check-in, signing a registration card, or making a traditional booking and paying a deposit, down payment, or the total amount due for the stay at the Hotel.
- By performing any of the aforementioned actions, the Guest confirms that they have read, understood, and fully accept all the provisions of these Terms.
- The Terms apply to all persons staying on the premises of Hotel Kasztelan***.
- The Terms are available for inspection at the Hotel Reception and on the website www.hotelkasztelan.pl. An excerpt from the Terms is available in each hotel room.
- Pictogram and information signs placed on and around the Hotel premises constitute an integral part of these Terms. Users are strictly required to comply with the information displayed on the pictogram and information signs.
§2 Technical Conditions for the Provision of Electronic Services
- To use the online booking system and the remote self-check-in system on the website www.hotelkasztelan.pl, it is necessary to have:
- a device with access to the Internet,
- an installed and updated web browser (e.g., Google Chrome, Mozilla Firefox, Safari, Microsoft Edge, Opera),
- an active email account,
- enabled support for cookies and JavaScript.
- The user of the online systems is strictly prohibited from providing content of an unlawful nature, including entering false personal data or third-party payment data.
§3 Online Booking and Payments (GuestsSage System and Przelewy24)
- The primary method for making direct bookings is the GuestsSage online booking system available on the website www.hotelkasztelan.pl.
- To make an online booking, the Guest follows the purchase path: selecting dates, configuring the room and optional extras, completing the Guest's personal data form, choosing a payment method, and accepting the terms and conditions.
- Online bookings made via the website are non-refundable.
- A mandatory condition for a successful online booking and room guarantee is making a prepayment of 100% of the planned stay value directly during the booking process.
- Electronic payments are processed via the payment operator Przelewy24 (PayPro S.A. with its registered office in Poznań). Available payment methods (including BLIK, fast internet transfers, payment cards) are presented in the operator's payment gateway.
- The contract is deemed concluded upon successful authorization of the payment by the operator Przelewy24 and the generation of an automatic booking confirmation by the GuestsSage system, which is sent to the Guest's email address.
- All prices presented in the booking system are gross prices (including VAT) and are expressed in Polish Zloty (PLN).
§4 Traditional Bookings and Card Guarantees
- In exceptional situations, the Hotel allows bookings to be made via traditional means (email to recepcja@hotelkasztelan.pl or by phone). In such cases, payment terms, deposits, and booking confirmations are determined individually with the Reception.
- In the case of bookings made via external booking portals (e.g., Booking.com), where payment card details (e.g., virtual or physical) are collected as a booking guarantee, the Guest's failure to arrive at the property entitles the Hotel to charge the provided card with the amount for the stay in accordance with the terms of the selected external booking.
- In the case of a traditional deposit payment for a manual booking, the Guest's failure to arrive at the Hotel by 6:00 AM the following day is equivalent to resignation from the stay, unless the Guest has previously notified the Hotel by phone, in writing, or by email to recepcja@hotelkasztelan.pl.
- In the case of failure to cancel a traditional room booking by 6:00 PM on the day of arrival – if the Hotel holds the card number of a Guest who failed to arrive at the planned date – the Hotel charges a fee for one hotel night.
§5 Remote Check-In (Online Check-In)
- The Hotel enables Guests to complete the check-in process remotely (online check-in).
- The Guest completes the online check-in using their own mobile or desktop device (smartphone, tablet, computer) by filling out an electronic form and entering their required personal data.
- Upon successful completion and submission of the data by the Guest, the system automatically processes the information to prepare the registration card.
- The Guest is obliged to provide data consistent with the facts. The Hotel reserves the right to verify the Guest's identity based on a photo ID at any time during the stay.
§6 Absence of Right to Cancel and Cancellation Policy
- Pursuant to Article 38(12) of the Polish Act of 30 May 2014 on Consumer Rights, a consumer does not have the right to withdraw from a contract for the provision of accommodation services (other than for residential purposes) concluded at a distance, if the contract specifies a specific day or period of service provision. The standard 14-day right to return purchases made online does not apply.
- All bookings made via the online booking system on the website are non-refundable offers.
- In the case of booking cancellation, date modification, shortening of the stay, or failure of the Guest to arrive at the Hotel (No-Show), the amount paid online (100% of the stay value) is non-refundable.
- If a Guest decides to leave the Hotel before the end of their scheduled stay, the fee paid for the current hotel night is non-refundable.
§7 Hotel Night
- Rooms at Hotel Kasztelan*** are rented for hotel nights.
- A hotel night lasts from 3:00 PM to 11:00 AM the following day.
- If the Guest does not specify the duration of their stay when renting a room, it is assumed that the room has been rented for one night.
- Remaining in the room after 11:00 AM is treated as an extension of the hotel night. If the Guest leaves the room after 11:00 AM, a fee will be charged according to the applicable price list.
- Information regarding fees for extending the hotel night is provided by the Hotel Reception.
- Requests to extend the hotel night should be reported to the Hotel Reception as soon as possible, and no later than 10:00 AM on the day the room rental expires.
- The Hotel will accommodate requests for stay extensions subject to the availability of vacant rooms. The Hotel may decline a request if all beds are occupied or in the case of Guests who fail to comply with these Terms.
- The Hotel reserves the right to refuse a stay extension if full payment for the current stay has not been made previously.
§8 Check-In and General Rules of Stay
- Checking in to the Hotel (both online and on-site) is equivalent to accepting the Terms of Hotel Kasztelan***.
- The basis for on-site check-in is the presentation of a photo ID to the Reception staff and the signing of the registration card. In case of refusal to present the document, the Hotel has the right to refuse the Guest's check-in.
- Payment for the Guest's stay (in the case of traditional bookings that were not paid 100% online) is due in advance at the moment of check-in at the Hotel.
- The Hotel may refuse to accept a Guest who, during a previous stay, grossly violated the regulations, caused damage to the property of the Hotel or other Guests, caused personal injury, or otherwise disrupted the peaceful stay of Guests or the functioning of the Hotel.
- During on-site check-in or key collection, the Reception issues a room card. Every Guest is obliged to return the issued set no later than at the time of check-out. For the loss or destruction of the card, the Guest will be charged a fee of 250.00 PLN.
- The Guest may not transfer the room to other persons, even if the period for which they paid the due fee has not expired.
- Unregistered persons may visit checked-in Guests in the public areas of the Hotel from 3:00 PM to 8:00 PM. Unregistered persons are not allowed on the Hotel premises after 9:00 PM.
- The presence of unregistered persons in the hotel room after 8:00 PM is equivalent to the Guest's consent to the paid accommodation of these persons. The accommodation of each person will be billed according to the current extra bed price from the price list available at the Hotel Reception.
§9 Quiet Hours
- Quiet hours apply at the Hotel from 10:00 PM to 6:00 AM.
- During quiet hours, Guests and persons using the Hotel's services are obliged to behave in a manner that does not disrupt the peace of other individuals.
- In the event of a breach of the provisions of these Terms, the Hotel may refuse to provide services to the person violating them. Such person is obliged to immediately comply with the Hotel's demands, settle the amounts due for current services, pay for any damage, and leave the Hotel.
§10 Services and Obligations of the Hotel
- The Hotel provides services in accordance with its category and standard.
- In case of complaints regarding the quality of services, the Guest is requested to report them to the Hotel Reception as quickly as possible.
- The Hotel undertakes to ensure: conditions for the Guest's full and undisturbed rest; safety of the stay, including maintaining the confidentiality of information about the Guest; professional and polite service; performing necessary repairs; technical efficiency of services.
- At the Guest's request, the Hotel provides the following services free of charge:
- providing information related to the stay and travel,
- wake-up calls at a designated time,
- forwarding correspondence for Guests,
- storing money and valuables in the safe up to a value of 2,000.00 PLN,
- storing the luggage of checked-in Guests,
- ordering a taxi,
- lending an iron and ironing board,
- wireless Internet access,
- use of the free parking lot.
- In the event of technical faults that cannot be rectified, the Hotel will make every effort to change the room if possible or otherwise mitigate the inconvenience.
§11 Obligations of Guests
- Each time when leaving the room, the Guest should close the windows, turn off the taps, and check that the door is locked.
- Hotel Guests are obliged to read the fire safety instructions available in the room and at the Reception and to comply with them.
- Due to fire safety, it is forbidden to use heaters, electric irons, and other devices in the rooms that do not constitute the room's equipment, as well as to use open fire and to smoke tobacco, tobacco products, and other substances.
- In the case of an unjustified triggering of the fire alarm, the Guest will be charged with the costs of the intervention of the Fire Department and the Police.
- Dangerous goods – weapons and ammunition, flammable, explosive, and illuminating materials – cannot be stored in hotel rooms.
- A total smoking ban on tobacco and other substances applies throughout the entire Hotel. Smoking is allowed only in designated areas.
- Violation of the smoking ban in a hotel room is equivalent to consenting to cover the costs of cleaning and ozonating the room in the amount of 500.00 PLN.
- It is forbidden to bring bicycles and other similar vehicles into hotel rooms.
- Excessive noise on the Hotel premises and behaviors that disturb, harm, or irritate other Guests are forbidden.
- It is forbidden to make any changes to the hotel rooms and their equipment, except for minor rearrangements of furniture that do not affect their functionality and safety.
- It is forbidden to throw any items out of the window.
- It is forbidden to sit on window sills and balcony railings due to the risk of falling.
- In case of violation of the provisions of these Terms, the Hotel may refuse to provide services to the person violating them. Such person is obliged to immediately comply with the Hotel's demands, settle the amounts due, pay for any destruction, and leave the Hotel.
§12 Liability of Guests
- The hotel Guest bears full financial responsibility for any damage, damage to, or destruction of equipment and technical devices of the Hotel caused by their fault or the fault of persons visiting them.
- Children under 13 years of age should be under the constant supervision of legal guardians on the Hotel premises.
- Guardians bear financial responsibility for all damages resulting from the actions of children.
- The Guest should notify the Hotel Reception of the occurrence of damage immediately upon its discovery.
§13 Liability of the Hotel
- The Hotel is liable for the loss or damage of items brought in by persons using its services within the scope specified by the provisions of the Polish Civil Code.
- The Hotel's liability for the loss or damage of money, securities, valuables, or items of scientific or artistic value is limited unless these items are deposited in the hotel safe.
- The Hotel has the right to refuse acceptance for storage of money, securities, and valuable items if they threaten safety, have too high a value in relation to the size or standard of the Hotel, or occupy too much space.
- The Hotel is not liable for damage to or loss of a car or other vehicle belonging to the Guest, items left in it, or live animals, regardless of whether the vehicle was parked in the hotel parking lot or outside the Hotel premises.
- Selected areas of the Hotel are monitored (video surveillance).
§14 Return of Left Items
- Personal items left in hotel rooms by a departing Guest will be sent back to the address indicated by the Guest at their expense.
- If the Hotel does not receive such instructions from the Guest, the Hotel will store the items for 3 months, after which they will be disposed of.
§15 Complaints (Including Complaints on Online Booking and Payments)
- Guests have the right to file complaints in the event of noticing deficiencies in the quality of services provided by the Hotel, the functioning of the booking system, or the process of fast online payments.
- All complaints are accepted by the Hotel Reception and can be submitted electronically to the address: recepcja@hotelkasztelan.pl.
- The complaint should be submitted by the Guest immediately after noticing the deficiency in the standard of services provided.
- Complaints are resolved within 14 days from the date of their proper submission. The Guest will be notified of the outcome of the procedure by email.
§16 Stay of Domestic Pets
- Hotel Kasztelan*** accepts Guests with their domestic pets. The acceptance of a pet should be preceded by a notification during booking. Consent is granted by the Hotel Management.
- An additional fee applies for the stay of a pet according to the current price list.
- Only domestic pets may stay in the Hotel. When making a decision, the Management takes into account the temperament and training of the animal.
- The Hotel does not consent to accept animal breeds listed in the Regulation of the Polish Minister of Interior and Administration regarding the list of dog breeds considered aggressive, as well as reptiles, amphibians, arthropods, rodents, and other animals deemed dangerous.
- Animals must be kept in the rooms. Dogs and other animals that may pose a threat must be walked on a leash and in a muzzle under the care of the owner or an authorized person.
- It is forbidden to bring animals into gastronomic outlets, onto the children's playground area, and the pool area.
- Pet owners must provide bedding for them.
- If the bedding in the room where the pet stays is soiled or damaged by it, the owner is obliged to purchase a whole new set of bedding according to the supplier's current prices.
- Pet owners must immediately clean up waste left by animals around the Hotel environment.
- No animal should be left alone in a hotel room. The Hotel reserves the right for staff to enter the room and remove the animal if the peace or safety of other Guests is threatened. All costs shall be covered by the pet owner.
- Owners are responsible for peace and quiet from their pets. In case of repeated complaints, the Hotel reserves the right to remove the animal from the Hotel.
- Any damage caused by animals is assessed by the Hotel Management, and the costs are charged to the owner.
§17 Gastronomy
- Guests are prohibited from taking food and drinks out of the restaurant. Taken dishes and drinks are subject to an additional fee.
- In particularly justified cases, the Reception may grant permission to take meals without additional fees.
- It is forbidden to enter the Restaurant area in bathrobes, swimwear, ski boots, or with animals.
- It is forbidden to bring and consume one's own food and alcohol on the restaurant premises. In justified cases, the Reception may consent to bring alcohol, for which a corkage fee is charged.
- Guardians are responsible for the safety of children within the gastronomic outlets and are obliged to exercise constant supervision.
§18 Personal Data (GDPR)
- The Guest consents to the storage and processing of personal data by Hotel Kasztelan*** for purposes necessary to fulfill the stay, check-in purposes, and use of the Hotel's services. The Guest has the right to access and correct their personal data.
- The data controller is Elżbieta Kudlik, ul. Przedbronie 3, 32-410 Dobczyce, Poland, NIP: 681-150-00-53.
- Data is processed for the purpose of executing the booking, providing hotel services, processing online payments, and for tax and accounting purposes. Detailed rules and full rights of Guests are specified in the Privacy Policy available on the website www.hotelkasztelan.pl.
§19 TERMS OF USE FOR THE EXTERNAL JACUZZI
1. GENERAL PROVISIONS
- These terms of use (hereinafter referred to as the "Jacuzzi Terms") define the rules for using the open-air external jacuzzi located on the premises of the hotel property "Hotel Kasztelan".
- Before entering the jacuzzi area, it is absolutely mandatory to read the contents of these Jacuzzi Terms. Starting to use the jacuzzi is equivalent to accepting all its provisions.
- The external jacuzzi area is a place intended for rest and relaxation. All users are obliged to maintain peace and cultured behavior.
2. OPENING HOURS AND BOOKING RULES
- The jacuzzi is open daily from 09:00 AM to 09:00 PM.
- The standard cost of using the jacuzzi is 120 PLN per 1 hour (60 minutes).
- During the hours when fees apply, a prior time slot booking at the hotel reception is required. Using the jacuzzi without a booking is prohibited.
- Holiday exception: During the summer period (months of July and August), daily from 04:00 PM to 06:00 PM, use of the jacuzzi is completely free of charge and does not require prior booking. During this time, a first-come, first-served principle applies, while maintaining the maximum limit of people allowed in the tub simultaneously.
- Additional services and accessories (available at reception):
- Towel rental: 8 PLN / pc.
- Bathrobe rental: 30 PLN / pc.
3. SAFETY AND HYGIENE RULES
- Before each entry into the jacuzzi tub, the user has an absolute obligation to thoroughly wash their entire body under the shower using soap or gel and rinse their feet.
- Users must stay in the jacuzzi exclusively in a clean swimsuit or swimming trunks.
- The maximum number of people allowed in the jacuzzi simultaneously is 6 people.
- Children and teenagers under 16 years of age may stay in the jacuzzi area and use the bath exclusively under the constant care and supervision of parents or adult legal guardians, who bear full responsibility for their safety.
- Persons with unstable health conditions (including cardiovascular diseases, heart diseases, hypertension, diabetes, pregnant women) should consult their desire to use the jacuzzi with a doctor. The Hotel is not liable for any deterioration of health resulting from not adjusting the bath profile to medical contraindications.
4. PROHIBITIONS AND RESTRICTIONS
- In the jacuzzi area and in the tub itself, there is a strict ban on bringing and consuming alcoholic beverages as well as any food items.
- In the jacuzzi area, there is a total ban on introducing and keeping animals.
- It is forbidden to bring glass, sharp, or other objects into the water that may pose a threat to the safety of users or the technical integrity of the device.
- It is forbidden to use the jacuzzi by persons whose condition indicates the consumption of alcohol, narcotics, or psychotropic substances.
- It is forbidden to use one's own cosmetics (oils, bath liquids, shampoos, etc.) in the jacuzzi, to enter the water with makeup or body lotion on the body, or to contaminate the water in any other way.
- In the external area, behaviors that create a hazard (e.g., running on wet surfaces, jumping into the water, diving) are prohibited.
5. LIABILITY AND FINAL PROVISIONS
- Users bear full financial responsibility for any damages, damage to, or destruction of jacuzzi elements or the surroundings of the relaxation area caused by their fault or the fault of persons under their care.
- For a gross violation of the rules of jacuzzi use, leading to its contamination that requires water replacement or causing any technical damage, the user will be charged a repair fee/compensation of a minimum of 500 PLN. In the case of more serious damage, this amount will be appropriately increased to the full value of rectifying the damage, covering service costs, and device downtime.
- The Hotel is not liable for personal belongings, documents, jewelry, or money left in the jacuzzi area.
- In the event of a gross violation of the provisions of these Jacuzzi Terms, the hotel staff has the right to order the user to immediately leave the jacuzzi area without the right to a refund for the purchased service.
- Any irregularities, technical faults, or water contaminations should be reported immediately to the reception staff.
§20 Final Provisions and Emergency Numbers
- The entity responsible for the functioning of Hotel Kasztelan*** is Elżbieta Kudlik, ul. Przedbronie 3, 32-410 Dobczyce, Poland; NIP: 681-150-00-53.
- Hotel Kasztelan*** settles corrective invoices in accordance with the provisions of applicable tax law.
- Complaints and requests related to the stay should be reported directly to the Hotel Reception, in writing, or via email to: recepcja@hotelkasztelan.pl.
- In matters not regulated by these Terms, the relevant provisions of the Polish Civil Code, the Act on Consumer Rights, and the Act on the Provision of Services by Electronic Means shall apply.
- A Guest who is a consumer has the opportunity to use out-of-court methods for resolving complaints and pursuing claims. They can, among others, use the EU ODR (Online Dispute Resolution) platform available at: http://ec.europa.eu/consumers/odr, or turn to the competent municipal or district consumer ombudsman.
- Annex to the regulations: An integral part of these Terms are also regulations specifying the rules for using individual attractions or additional services provided by the Hotel (including the Terms of Use for the External Jacuzzi included above).
- These Terms come into force on the day of their publication on the property's website.
